Cowboys' Ezekiel Elliott suspended six games for conduct
OXNARD, California -- Dallas Cowboys running back Ezekiel Elliott has been suspended six games by the NFL for violating the personal conduct policy, the league announced Friday.

The suspension comes as a result of an investigation that started more than a year ago after an ex-girlfriend accused Elliott of domestic violence in Columbus, Ohio. The Columbus City Attorney's office announced in September that it would not pursue charges against Elliott because of "conflicting and inconsistent information," but the NFL can penalize a player even without legal charges.

Elliott is expected to appeal the suspension, league sources told Schefter.

Elliott has three business days to file notice of appeal, and a hearing must be scheduled within 10 days of receipt of the notice, according to Article 46 of the collective bargaining agreement, which governs appeal of commissioner discipline.

Commissioner Roger Goodell or his designee, usually former NFL executive Harold Henderson, would hear the appeal.

Without an appeal, Elliott's suspension would begin Sept. 2. He would be eligible to return to the active roster Oct. 23, the day after the Cowboys' Week 7 game against the San Francisco 49ers.

Ezekiel Elliott suspension reinstated after court ruling
A federal appeals court overturned a district court's decision in the Ezekiel Elliott case Thursday, meaning the Dallas Cowboys running back's six-game suspension has been reinstated.

The 5th U.S. Circuit Court of Appeals ruled 2-1 in favor of the NFL that the district court did not have subject matter jurisdiction in Elliott case after hearing oral arguments from the league and NFL Players Association lawyers earlier this month. The decision vacated the preliminary injunction and directed an order to the U.S. District Court for the Eastern District of Texas to dismiss the case.

"Earlier today, the Fifth Circuit Court of Appeals vacated the preliminary injunction that prohibited the league from imposing the six-game suspension issued to Ezekiel Elliott for a violation of the Personal Conduct Policy," the league wrote in a statement. "The Court also directed the district court to dismiss the union's lawsuit which was filed on Elliott's behalf. As a result, Elliott's suspension will begin effective immediately. Elliott is eligible to return to the team on Friday, November 24 following the Cowboys' Thursday, November 23 game against the Los Angeles Chargers."

The NFLPA also issued a statement on the court's decision: "The NFLPA is reviewing the decision and considering all options. The appellate court decision focuses on the jurisdictional issues. The failure of due process by the NFL articulated in the district court's decision were not addressed."

Elliott's lawyer, Frank Salzano, released the following statement to NFL Network Insider Ian Rapoport regarding Thursday's ruling:

"We are currently exploring all of our legal options and will make a decision as to what is the best course of action in the next few days. Until that time we have no further comment on the 5th circuit's decision."

The NFLPA is expected to re-file the case with the U.S. District Court for the Southern District of New York and seek a temporary restraining order and preliminary injunction in order to keep Elliott playing, according to Gabe Feldman, director of the Tulane Sports Law Program. The Cowboys have a bye this week and there's a chance Elliott might not miss a single game if the NFLPA refiles the case and is granted a TRO or preliminary injunction.

Elliott and the NFLPA have other legal options as well. They could seek an en banc hearing with the 5th Circuit or refile an amended lawsuit in Texas, according to Feldman.

"So the Players Association could ask the district court in New York or perhaps some other court to reinstate the preliminary injunction, which would put that suspension back on hold," Feldman said on NFL Network's TNF First Look. "So this is not over yet, particularly with the bye week, that Elliott will not serve the suspension.

Jerry Jones Mad At The System He Helped Create
Cowboys owner and NFL shadow commissioner Jerry Jones isn’t happy that a federal appeals court vacated Ezekiel Elliott’s injunction, thus clearing the way for the running back’s six-game suspension. Jones’s mood is to be expected, but—surprise!—he also isn’t happy about the extrajudicial process that led the league to suspend Elliott in the first place. Never mind that NFL owners like Jones are responsible for the existence of that process.

In an interview this morning with 105.3 The Fan in Dallas, Jones decried what he described as the unfairness of the NFL’s disciplinary system. That system vests commissioner Roger Goodell with unchecked authority and was expanded three years ago to grant the league broad investigatory powers. Its reach also extends beyond the confines of the U.S. criminal justice system.

Remember: Jones was fine with this process when Tom Brady was in the league’s crosshairs. Now that the system is chewing up one of Jones’s own star players? Totally unfair. Who could possibly have seen that coming?

Apparently he's back off suspension now. Anyone know how many courts they can go to for this crap? Ridiculous.

Cowboys RB Ezekiel Elliott again suspended after court denies motion
FRISCO, Texas -- The emergency injunction request by the NFL Players Association on behalf of Dallas Cowboys running back Ezekiel Elliott was denied by the 2nd U.S. Circuit Court of Appeals on Thursday.

The ruling means Elliott's six-game suspension is back on and he is currently ineligible to play Sunday against the Atlanta Falcons.

The 2nd U.S. Circuit Court of Appeals did stipulate that the NFLPA's appeal of Thursday's ruling would be heard on an expedited basis. No date for that hearing was set, and the court is closed Friday to recognize Veterans Day, which falls on Saturday this year.

Elliott will be placed on the suspended list for the second time in as many weeks. Last week, he was granted a temporary administrative stay from the 2nd Circuit after Judge Katherine Polk Failla denied his request for a preliminary injunction in the Southern District. The stay allowed him to play against the Kansas City Chiefs.

On Aug. 11, the NFL announced Elliott had been suspended six games for violating the personal conduct policy. The league said it found persuasive evidence that he committed domestic violence against a former girlfriend on multiple occasions in July 2016 in Columbus, Ohio.

That set off legal maneuvering that has kept Elliott on the field for the first eight games of the season. Elliott won a preliminary injunction at a district court in Sherman, Texas, in September, but the 5th U.S. Circuit Court of Appeals ruled that court never should have heard Elliott's case. Polk Failla heard the case in the Southern District last week and denied the request.

Ezekiel Elliott withdraws appeal, will serve full 6-game ban
FRISCO, Texas -- The next time Ezekiel Elliott carries the ball for the Dallas Cowboys will be Dec. 24 against the Seattle Seahawks.

Elliott has withdrawn his appeal to the 2nd U.S. Circuit Court of appeals. A hearing had been scheduled for Dec. 1 for a potential preliminary injunction.

In a statement, Elliott's agents, Rocky Arceneaux and Frank Salzano, said: "In consultation with the NFLPA and his lawyers, and after careful deliberation and review of the recent Second Circuit decisions, Mr. Elliott has decided to forgo any further appeals and will serve the remaining suspension. This decision arises from a practical assessment of the current legal landscape. Mr. Elliott's desire for closure in this matter is in his best interests, as well as the best interests of his teammates, family and friends.
